Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG)

The Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG) has been around since 1977, but has largely been replaced by the General Data Protection Regulation as of May 25, 2018. The Data Protection Adaptation Act (DSAnpUG) transposes the General Data Protection Regulation into German law and revises the BDSG so that from May 2018, it is largely congruent with the provisions of the General Data Protection Regulation. In some cases, however, the General Data Protection Regulation allows national legislators some leeway for their own implementations, which Germany has made use of. Such exceptions or restrictions to the rights of data subjects are explained in this dictionary in the respective entries on the rights.
